II. General information on data processing

Personal data is all data that can be directly or indirectly related to you personally, e.g. name, address, e-mail addresses, user behavior.

1. Scope of the processing of personal data

We process data in accordance with GDPR Art. 6 para. 1 lit. a) b) c) f). This means that we only process personal data if consent has been given (lit. a), if necessary for the fulfillment of a contract or pre-contractual measures (lit. b), if we are legally obliged to do so (lit. c) or if we have a legitimate interest in the processing (lit. f). The relevant legal basis will be specified in each individual case. 

We collect and use our users' personal data only insofar as this is necessary to provide a functional website and our content and services. The collection and use of our users' personal data only takes place regularly with the user's consent. An exception applies in cases where prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law. 

Customers, interested parties, business partners and website visitors are affected by the processing. The purpose and our interest in the processing lies in the administration, financial accounting, office organization, archiving of data, i.e. tasks that serve to maintain our business activities, perform our tasks and provide our services. The deletion of data with regard to contractual services and contractual communication corresponds to the information specified in these processing activities.

2. Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a GDPR serves as the legal basis for the processing of personal data. When processing personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures. Insofar as the processing of personal data is necessary to fulfill a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis. If the processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for the processing. 

Insofar as we obtain the consent of the data subject for the processing of special categories of personal data, Art. 9 para. 2 lit. a GDPR serves as the legal basis for the processing of personal data, unless one of the exceptions regulated in Art. 9 para. 2 lit. b to j GDPR applies.

3. Data erasure and storage duration

The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Data may also be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.

4. Technical and organizational protective measures

We use technical and organizational security measures to protect the data you provide against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. When personal data is collected and processed, the information is transmitted in encrypted form to prevent misuse of the data by third parties. Our security measures are continuously revised in line with technological developments. 

The constant development of the Internet makes it necessary to adapt our privacy policy from time to time. We reserve the right to make corresponding changes at any time (see Section XIII.).

5. Transmission to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries (i.e. outside the EU or the European Economic Area, EEA). We would like to point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. We have no influence on the processing activities. If third countries process your data on the basis of the activated tools, this will only take place if it is done to fulfill our (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests.

III. Provision of the website and creation of log files

Each time our website is accessed, data and information is automatically collected from the computer system of the accessing computer by our website host Shopify (see IX.). The following data may be collected:

  • Information about the browser type and the version and add-ons used
  • The user's operating system and its interface

The data is also stored in the log files. The processing is necessary in accordance with Art. 6 para. 1 lit. f GDPR to safeguard our legitimate interests and serves to deliver the content of our website, to ensure the functionality, stability and security of our information technology systems and to optimize our website as well as the optimal display on your output device. The log file data is always stored separately from other personal user data.

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended. If the data is stored in log files, this is the case after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are deleted or anonymized so that it is no longer possible to identify the accessing client.

The collection of data for the provision of the website and the storage of data in log files is absolutely necessary for the operation of the website. Consequently, the user has no option to object.

IV. Use of cookies

1. Description and scope of data processing

Our website uses cookies. Cookies are small text files that are automatically stored on your end device. Some of the cookies we use are deleted again at the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your end device and enable us to recognize your browser on your next visit (persistent cookies). When a user accesses a website, a cookie may be stored on the user's operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again.

We use cookies to make our website more user-friendly. Some elements of our website require that the accessing browser can be identified even after a page change. We also use cookies on our website that enable an analysis of the user's surfing behavior. In this way, for example, search terms entered, the frequency of page views and the use of website functions can be transmitted

The legal basis for the processing of personal data using cookies is Art. 6 para. 1 lit. f GDPR. The legal basis for the processing of personal data using technically necessary cookies is Art. 6 para. 1 lit. f GDPR. The legal basis for the processing of personal data using cookies for analysis purposes is Art. 6 para. 1 lit. a GDPR if the user has given consent to this. 

3. Duration of storage, objection and removal options

Cookies are stored on the user's computer and transmitted by it to our website. As a user, you therefore have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies that have already been saved can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to use all functions of the website to their full extent.

V. Orders and contract execution

1. Data categories and disclosure of data to third parties:

When you place an order in our online store, we collect and process the following personal data:

(1) Personal data: First and last name, billing and delivery address, e-mail address, telephone number. 

(2) Payment information: For payment processing, your payment information is transmitted to the respective provider, e.g. to:

(3) Order details: ordered items, order number, invoice amount, delivery status. 

(4) Customer account: If you create a customer account, we will also save it:

  • Your login details (e-mail and password),
  • the order history to give you an overview of your previous orders.

We pass on your address data to logistics companies and shipping service providers for the dispatch and delivery of your order. 

2. Purpose of data processing

Data processing is carried out for the purpose of fulfilling and processing your order, communication in the context of order processing and delivery of the goods. The payment information is used to carry out the payment process. The registration and order data are processed to provide and manage your customer account and to simplify future orders. Customer data may be used to check creditworthiness if this is necessary in the context of payment processing.

3. Legal basis

The processing is necessary for the performance of a contract with you pursuant to Art. 6 para. 1 lit. b GDPR and we have a legitimate interest, Atz. 6 para. 1 lit. f GDPR.

4. Storage duration

Your data will be stored for as long as is necessary to fulfill the contractual relationship or due to statutory retention periods.

VII. Contact form and chat

1. Description and scope of data processing

There is a contact form on our website that can be used to contact us electronically. If a user makes use of this option, the data entered in the input mask will be transmitted to us and stored. These data are

  1. Name
  2. E-mail address
  3. Location

The following data is also stored at the time the message is sent:

  1. IP address of the user
  2. Date and time of contact 

Alternatively, you can contact us via live chat. In this case, your personal data transmitted in the chat will be stored. This data is used exclusively for processing the conversation and for a reply by e-mail if you so wish.

2. Legal basis and purpose of data processing 

If you contact us as part of an existing contractual relationship or contact us in advance for information about our range of services or our other services, the data and information you provide will be processed for the purpose of processing and responding to your contact request in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR. Otherwise to safeguard our legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR for the purpose of responding appropriately to customer/contact inquiries.

3. Duration of storage

The data you enter in the contact form will remain with us until the purpose for data storage/processing no longer applies (e.g. after your request has been processed). Mandatory statutory provisions - in particular retention periods - remain unaffected. 

VIII. Transfer of data to service providers (third parties)

We work with various service providers to provide and optimize our services. Unless listed separately elsewhere, you will find the service providers named below.

  • Google Analytics
  • Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland

    Purpose: To analyze and improve our website and to compile usage statistics.

    We use Google Analytics, a web analysis service from Google, to analyze the use of our website and to optimize our offer. Personal data such as IP address, browser type, operating system, referrer URL and usage behavior are collected. For anonymization purposes, your IP address will be truncated before processing if you are located in an EU member state or a signatory state to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google uses the data collected to compile reports on website activity and to provide other services relating to website activity and internet usage.

    Data transfer to third countries: Google may transfer your data to servers in the USA. To ensure an adequate level of data protection, Google uses the standard contractual clauses approved by the EU.

    We use Torque WMS, a warehouse management software from Torque Ltd, to manage our inventory and optimize logistical processes. The processing of your order and shipping data is carried out for the efficient processing of orders and to improve our goods management. Order, shipping and inventory data are processed to ensure proper warehouse management.

    Purpose: Analysis and reporting of usage data

    Purpose: We use Big Query Data Warehouse, a cloud-based data processing and analysis platform from Google LLC, to store and analyze data from our online store. This is used to efficiently process and evaluate large amounts of data required for operational purposes, including optimizing customer interaction, analyzing sales statistics and improving our services.

    Personal data such as order information, user behavior and transaction data may be processed. This processing takes place in order to make our offer more user-friendly and to enable relevant analyses for operational decisions.

    We use Trustpilot, a platform for customer reviews, operated by Trustpilot A/S. Personal data such as name, rating and e-mail address are processed to manage and publish customer reviews. This serves to authenticate reviews and improve our service quality. Trustpilot processes the data in accordance with EU data protection regulations. Data may be transferred outside the EU. Trustpilot ensures that appropriate safeguards, such as EU standard contractual clauses, are in place to ensure an adequate level of data protection.

    Legal basis and storage period: Your data is processed either on the basis of your consent, Art. 6 para. 1 lit. a GDPR, or on the basis of our legitimate interest, Art. 6 para. 1 lit. f GDPR. Your data will only be stored for as long as is necessary to fulfill the purposes described or as long as there are legal obligations to retain data.

     

    IX. Newsletter, use of Klaviyo

    With your consent, you can subscribe to our newsletter, with which we inform you about current topics of our company and new products. We use the so-called double opt-in procedure to subscribe to our newsletter. This means that after you have registered, we will send you an e-mail to the e-mail address you have provided in which we ask you to confirm that you wish to receive the newsletter. The registration remains valid even if you do not confirm the double opt-in message. In this case, Klaviyo will create an empty profile with the general properties of the form (such as first name, last name, e-mail address and telephone number), and no inclusion in the list and no further processing will take place.

    We use the service "Klaviyo" (Klaviyo, Inc., 125 Summer St, Floor 6, Boston, MA 02110, USA) to send our newsletter. Klaviyo is the recipient of your personal data and acts as a processor for us when it comes to sending and analyzing our newsletter. We have concluded an order processing contract with Klaviyo, which obliges Klaviyo to protect your data in accordance with the requirements of the GDPR and to process it exclusively in accordance with our instructions.

    The only mandatory information for sending the newsletter is your e-mail address. We also collect your first name so that we can address you personally in the newsletter. If you do not wish this, you can choose not to provide your first name. The provision of further, separately marked data is voluntary and is used to address you personally. After your confirmation, we will save your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 sentence 1 lit. a GDPR, Art. 7 GDPR i.V.m. § Section 7 para. 3 UWG. 

    In addition, Klaviyo collects and processes the following personal data using cookies and other tracking methods when sending the newsletter:

    • Information about your end device (IP address, device information, operating system, browser type, information about the application you use to read your e-mails and other information about hardware and Internet connection).
    • Usage data such as date and time, when you opened the email or campaign, your clicks on links in the email and the activities on our website (e.g. which pages were visited). Klaviyo also collects information about your region, city and other location-related data, but no information about your activities on other websites

    This data is used to ensure the security and reliability of the systems, to prevent misuse and to analyze the use and performance of the newsletter. The processing is carried out on the basis of a legitimate interest of Klaviyo (Art. 6 para. 1 lit. f GDPR) and serves the execution of the contract (Art. 6 para. 1 lit. b GDPR).

    Klaviyo also receives data from our Shopify system, e.g. information about your order, and may pass this data on to third parties such as Meta (Facebook) and Google. Further information on data processing by Klaviyo can be found in Klaviyo's privacy policy at:

    You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare your revocation by clicking on the link provided in every newsletter e-mail, by e-mail to our customer support at:hello@passenger-clothing.com or by sending a message to the contact details given in the imprint. The declaration of revocation does not affect the legality of the processing carried out to date.

    Your data will be processed as long as we have your consent to do so. After termination of the contract between us and Klaviyo or if you withdraw your consent, your data will be deleted unless further storage is required by law.

    X. Hosting

    This website is hosted by an external service provider (hoster). The hoster is Shopify Inc, Shopify International Limited, Victoria Buildings, 2nd floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland, a provider of e-commerce platforms and hosting services. The personal data collected on this website is stored on Shopify's servers.

    The hosting services we use serve to provide the following services:

    • Infrastructure and platform services,
    • Computing capacity, storage space and database services,
    • Security deposits and
    • technical maintenance services that we use for the purpose of operating this online service.

    When using these hosting services, we or our hoster process the following categories of data:

    • Inventory data (e.g. name, address),
    • Contact details (e.g. e-mail address, telephone number),
    • Content data (e.g. text input),
    • Contract data (e.g. concluded contracts, payment information),
    • Usage and transaction data (e.g. pages visited, click behavior),
    • Meta and communication data (e.g. IP addresses, browser type).

    Legal basis for data processing

    Data processing by Shopify is based on our legitimate interests in the efficient and secure provision of this online offer in accordance with Art. 6 para. 1 lit. b and f GDPR and on the basis of Art. 28 GDPR (conclusion of an order processing contract).

    Data transfer to third countries

    Your data is controlled by Shopify's Irish subsidiary, Shopify International Ltd, and transferred to other Shopify locations and service providers, which may be located in various regions, including Canada (where we are based) and the United States. Shopify is headquartered in Canada. Data processing is subject to the requirements of the GDPR, as Canada is considered a safe third country under the EU Commission's adequacy decision. The transfer to other countries only takes place within the framework of the legal requirements and on the basis of suitable guarantees (e.g. EU standard contractual clauses).

    XI. Encryption

    Our website uses SSL encryption for security reasons and to protect the transmission of confidential content, such as the application process via the form on our website that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you send to us cannot be read by third parties.

    You can request confirmation from the controller as to whether personal data concerning you is being processed by us. 

    In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information on its details (Art. 15 GDPR).

    4. Right to rectification 

    You have a right to rectification and/or completion vis-à-vis the controller if the processed personal data concerning you is incorrect or incomplete. The controller must carry out the rectification without undue delay (Art. 16 GDPR).

    5. Right to erasure

    You have the right to request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims (Art. 17 GDPR).

    6. Right to restriction of processing

    You can request the restriction of the processing of your personal data if a) the accuracy of the data is disputed by you, b) the processing is unlawful and you refuse to delete it, c) we no longer need the data, but you need it to assert, exercise or defend legal claims or d) you have lodged an objection to the processing in accordance with Art. 21 GDPR (Art. 18 GDPR).

    7. Right of objection

    You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR.     We use partially automated processing techniques (profiling) to provide you with personalized content and product recommendations.
